Monroe County, PA (Poconos) Business License: Township Permits, STR Rules and County Taxes
Monroe County, PA (Poconos) Business License: Township Permits, STR Rules and County Taxes
If you searched for a Monroe County business license, the short answer is that Monroe County does not issue one. Pennsylvania has no state general business license, and there are no county business licenses. For a Poconos business, the paperwork comes from three levels: the state, which handles entity formation and tax registration; the township or borough where your property sits, which controls zoning, short-term rental permits, occupancy limits and inspections; and Monroe County, which levies a hotel excise tax on overnight room rentals.
The East Stroudsburg micropolitan area, with 167,179 residents, depends heavily on tourism and seasonal business. Lodging, outdoor recreation, food service and short-term rentals all face the local rules covered here. This guide explains what to file, which office handles each item and what to confirm before you open.
No county business license: what that means
Monroe County does not issue a general business license. The Pennsylvania Department of State's Bureau of Corporations and Charitable Organizations does not issue activity licenses either. Whether you need a license depends on what you do and where you do it. Most Poconos owners end up dealing with the following:
| Requirement | Who handles it | What to confirm |
|---|---|---|
| Entity formation (LLC or corporation) | PA Department of State | Name availability and registered office address |
| State tax accounts | PA Department of Revenue, through myPATH | Which tax accounts your activity needs |
| Zoning and short-term rental permit | Township or borough | Rules for your zoning district and any permit fee |
| Occupancy limits and inspections | Township or borough | Maximum occupancy and inspection schedule |
| Hotel excise tax (3%) | Monroe County Treasurer | Registration and quarterly report dates |
| Earned Income Tax and Local Services Tax | Berkheimer Tax Administrator (Monroe Tax Collection District) | Current rates and filing schedule |
| Food service license | Pennsylvania Department of Agriculture (PDA) | Whether your food operation needs a PDA license |
Step by step: the order to work in
- Form your entity. An LLC files a Certificate of Organization (Form DSCB:15-8821) with a Docketing Statement (DSCB:15-134A) for a $125 filing fee. Processing takes about 15 business days. Expedited service online or in person adds $100 to $1,000 depending on how fast you need it.
- Set your registered office. Pennsylvania does not use registered agents. Every filing business must list a registered office with a street address in Pennsylvania, and a post office box alone is not accepted. If you have no Pennsylvania address, you can contract with a Commercial Registered Office Provider (CROP) under 15 Pa.C.S. section 109. Listing a CROP without a contract carries civil and criminal penalties.
- Check township zoning and short-term rental rules before you buy or lease. This is the step that most often changes a plan, so do it first.
- Register for state tax accounts on myPATH. The PA-100 was retired in 2022.
- Register for the Monroe County hotel tax if you rent any room with a bed to overnight guests.
- Confirm food licensing with PDA if you serve or sell food.
- File a fictitious name if you operate under a trade name rather than your legal name.
Township permits, zoning and short-term rental rules
Zoning and short-term rental rules come from each township's ordinance, and they differ from one township to the next. Two properties a few miles apart can fall under different rules for the same use, so do not assume a neighboring township's rules apply to yours. Questions about Monroe County zoning usually lead to the township office, because that is where the ordinance and the permit decision sit.
Start with the zoning ordinance
Before you sign a lease or close on a property, ask the township zoning office whether a short-term rental or commercial use is allowed in that zoning district. Ask for the ordinance section number and get the answer in writing if you can. The state agencies in this guide do not answer zoning questions.
Short-term rental permits
Some townships require a permit or registration before you rent a home to short-term guests. Whether your township requires one, what it costs, how long it lasts and what it requires are all township questions. This guide does not list those figures because they vary by township. Request the current application and fee schedule in writing before you market the property.
Occupancy limits and inspections
Occupancy limits and inspection rules vary by township. Ask three questions: what is the maximum occupancy for this property, who inspects it and how often, and what triggers a reinspection. Write the answers into your operating plan and guest booking terms. If an inspection fails, the time needed to fix it can delay your opening, so build a buffer into your schedule.
Monroe County hotel excise tax (3%)
Monroe County levies a 3% hotel excise tax under Ordinance 2017-1. It applies to every rental of a room with a bed, which includes hotels, bed and breakfasts, cabins and short-term rentals. If you rent a room with a bed to overnight guests in Monroe County, assume the tax applies and confirm the details with the Treasurer. Revenue goes to tourism promotion.
The tax creates two ongoing obligations:
- Registration. Register with the Monroe County Treasurer before you collect the tax from guests. If you run more than one property, ask whether registration is required for each one.
- Quarterly reports. File quarterly reports with the Treasurer. Confirm the due dates, the report form, and whether a report is required for a quarter with no rentals.
Keep dated rental records for every stay: the property, the number of rooms with beds, the guest dates and the rent charged. Your quarterly reports will draw from those records.
Earned income tax and Local Services Tax
If you have employees, the Monroe Tax Collection District's earned income tax (EIT) and Local Services Tax (LST) are collected by Berkheimer Tax Administrator. Do not confuse this with the hotel tax, which goes to the Monroe County Treasurer. This guide does not state current EIT or LST rates. Confirm the rates in effect for October 2026 with Berkheimer before your first payroll, and confirm which taxing jurisdiction applies to your business location and to where each employee lives and works. Rates can change.
State tax registration on myPATH
Register your business for state tax accounts through myPATH, the Department of Revenue's online system, at the state's business tax registration page. The state sales tax rate is 6%. Lodging operators may also need the Sales, Use and Hotel Occupancy Tax License, depending on their activity.
Income tax depends on how your entity is taxed. A standard LLC follows its federal classification, so pass-through income is taxed to the owners at the flat 3.07% Personal Income Tax rate. An LLC taxed as a corporation pays the Corporate Net Income Tax, which is 7.49% for tax years beginning in 2026.
Food service and PDA licensing
Monroe County has no county health department handling food licenses. Food licensing runs through the Pennsylvania Department of Agriculture (PDA). Whether your operation needs a PDA license depends on what you sell and how you prepare it. Contact PDA before you finalize equipment, a kitchen layout or a menu, because those choices can change what you need.
Some trades need a separate state license. For example, home improvement contractors must register with the Pennsylvania Attorney General. If your Poconos business falls in a licensed trade, check that requirement on its own.
Entity formation, name rules and state fees
| Item | Fee | Where to file |
|---|---|---|
| LLC Certificate of Organization | $125 | Department of State, file.dos.pa.gov |
| LLC Annual Report | $7 | file.dos.pa.gov, January 1 to September 30 each year |
| Corporation Articles of Incorporation | $125 | Department of State, file.dos.pa.gov |
| Corporation Annual Report | $7 (nonprofits pay no fee) | file.dos.pa.gov, January 1 to June 30 each year |
| Fictitious name registration | $70 | Department of State, statewide and not the county |
| Name reservation | $70 for 120 days | Department of State |
Name rules. An LLC name must contain company, limited, limited liability company, or an abbreviation of one of those terms. It may not contain words implying a business corporation, such as corporation or incorporated. The name must be distinguishable on the state's records from any name already registered.
Publication. LLCs have no publication requirement. Corporations do: notice must run in two newspapers of general circulation, one preferably a legal journal, and proof belongs in your corporate minutes.
Fictitious names. Many rental owners operate under a property or brand name. That requires a Registration of Fictitious Name (Form DSCB:54-311) filed with the Department of State. There is no county DBA filing. A CROP cannot be used on a fictitious name registration because that filing requires a principal place of business.
Tourism and seasonal businesses
Seasonal operation does not pause your filings. An LLC's annual report is due every year between January 1 and September 30, whether or not you are open in winter. Corporations file between January 1 and June 30. Ask the Treasurer whether hotel tax reports are required for closed quarters.
Set up your entity, name and tax registrations before the season starts. Filings take about 15 business days, and township permit timelines are set locally, so they can take longer than you expect. The Pennsylvania Small Business Development Centers at pasbdc.org can help you plan.

When to get professional help
Poconos rentals stack township, county and state rules on top of each other. Talk to a CPA before you choose an entity or tax election, and before you set up hotel tax reporting and payroll withholding. Talk to a local attorney before you buy a property for short-term rental use or challenge a township decision.
