Cumberland County, PA Business License: Township Rules in the I-81 Warehouse Corridor

If you searched for a cumberland county business license, the short answer is that Cumberland County does not issue one. Pennsylvania has no state general business license, and there are no county business licenses. What you need depends on what you sell, how the building is zoned, whether you have employees, and which township or borough you operate in. Along the Interstate 81 corridor, most of the real local obligations come from the municipality, not the county.

Cumberland County is the fastest-growing county in Pennsylvania since 2020, up 6.9%. Trucking, warehousing and distribution have grown with it, and more new operators are asking the same questions about cumberland county permits, cumberland county zoning and the cumberland county building permit. This guide takes those questions in the order you will likely face them, and it explains which local taxes Pennsylvania routes through the cumberland county tax collector.

This guide is informational only. It is not legal, tax or zoning advice. Rules change, and township ordinances control many of the questions covered here. Confirm every item with the agency named before you sign a lease, buy property or file a return. For complex situations, talk with a qualified attorney or CPA.

The state filings come first, and there is no county license to get

Pennsylvania does not license most businesses at the state or county level. The Bureau of Corporations and Charitable Organizations does not issue activity licenses. Your first obligations are formation and tax registration. For an LLC, the core costs look like this:

ItemAmountNotes
Certificate of Organization (Form DSCB:15-8821) with Docketing Statement (DSCB:15-134A)$125 filing feeFiled online at file.dos.pa.gov. The Bureau asks filers to allow about 15 business days for processing.
Expedited service (optional)$100 same day, $300 3 hour, $1,000 1 hourOnline or in person only, added to the $125 fee. Same day requests must arrive before 10:00 a.m., 3 hour before 2:00 p.m., and 1 hour before 4:00 p.m.
Special Processing (optional)$70Added only if you need several same day documents filed in a specified order.
Name reservation$70Holds the name for 120 days.
LLC annual report$7Due January 1 through September 30 each year. This requirement began January 1, 2025.
Fictitious name (DBA) registration (Form DSCB:54-311)$70Filed with the Department of State statewide, not with the county.

Two details trip up first-time LLC filers. First, Pennsylvania uses a registered office, not a registered agent. You must list a Pennsylvania street address with a street and number, and a post office box alone is not accepted. If you have no Pennsylvania address, you can contract with a Commercial Registered Office Provider (CROP) under 15 Pa.C.S. section 109 and list the CROP name and its county of venue. Listing a CROP without a contract can carry civil and criminal penalties. Second, LLCs have no publication requirement. Corporations are different: Articles of Incorporation require notice in two newspapers, one preferably a legal journal, with proof kept in your minutes.

Register for state taxes through myPATH

The PA-100 was retired in 2022. Register state tax accounts through myPATH. If you sell taxable goods, you will need a sales tax account, and the state sales tax rate is 6%. You can start the registration at https://www.pa.gov/services/revenue/register-my-business-for-taxes.

Income tax depends on how the LLC is classified. A standard LLC is treated the same as its federal classification, so pass-through income is taxed to the owners at the flat 3.07% Personal Income Tax rate. An LLC taxed as a corporation pays Corporate Net Income Tax at 7.49% for tax years beginning in 2026. Pennsylvania has no LLC franchise tax and no separate annual LLC tax. Confirm which applies to you with a CPA before you pick a classification.

Why township rules decide most of your costs

Zoning, building permits and any business privilege or mercantile tax are set township by township. Do not assume a local business tax exists, and do not assume it does not. Hampden Township's tax collector lists only per capita and real estate taxes locally, so one municipality's tax list tells you nothing about the next one. Before you commit to a site, check with the municipality where the business will operate.

MunicipalityWhat to confirm before you commit
Hampden TownshipWhether any business privilege or mercantile tax applies. The local tax collector lists only per capita and real estate taxes, so confirm directly with the township.
Silver Spring TownshipZoning for your exact use, whether a local business tax applies, and which office issues building permits.
East Pennsboro TownshipZoning for your exact use, whether a local business tax applies, and which office issues building permits.
Your own municipalityThe same three items, plus sign, parking and truck access rules.

Cumberland County zoning and building permits along I-81

Cumberland County zoning is mostly a township question, so get the answers in writing. Before you sign a lease or buy a parcel for a warehouse, truck terminal or yard, ask the zoning office these questions:

  • Does the parcel's zoning allow your exact use, such as warehousing, distribution, truck parking, outdoor storage or a home-based office?
  • What setback, buffer or access requirements affect truck docks, parking and turning radius?
  • Does a change of use or a new tenant trigger new approvals?
  • Which office issues the building permit, and does the township or a third-party code agency handle inspections?
  • What is the current fee schedule and review timeline? This guide does not list building permit fees because they vary by municipality. Confirm them with the local office.

Plan the sequence. Zoning confirmation is the cheapest check you can make, so do it before you spend money on design, equipment or deposits. A building permit comes after the zoning answer is settled, and construction comes after the permit.

Food businesses: the state licenses them, not the county

Cumberland County has no county health department to license food operations. Food licensing runs through the Pennsylvania Department of Agriculture (PDA). If you plan to prepare, store or sell food, confirm which PDA license or registration applies before you buy equipment or sign a lease. Ask the same question about a cold storage or food warehouse operation. The PDA is the source for current fees and forms, not a county office.

Earned income tax and local services tax: the Cumberland County Tax Bureau

For the Cumberland Tax Collection District, the Earned Income Tax (EIT) and Local Services Tax (LST) collector is the Cumberland County Tax Bureau, formerly the West Shore Tax Bureau in Mechanicsburg. This is a local tax, separate from the state Personal Income Tax that goes to the Pennsylvania Department of Revenue.

If you have employees, you withhold local EIT and LST from their pay and remit it to this collector. Confirm your registration and remittance schedule with the Tax Bureau when you hire your first employee. Do not estimate the schedule from memory or from another county's rules.

Hotel room rental tax: 5% for hotels, B&Bs and short-term rentals

Cumberland County's hotel room rental tax is 5%, raised by Ordinance 2023-2. Every hotel, bed and breakfast and short-term rental owner collects it. The steps are:

  1. Register with the Cumberland County Treasurer. Confirm the deadline and whether you must register before accepting bookings.
  2. Collect the tax on each taxable stay.
  3. File a monthly report and pay by the 20th of the following month.
  4. Keep filing even when Airbnb or VRBO remits the tax for you. The platform's remittance does not replace your own monthly report.

Example: on a $1,000 taxable room charge, the county tax is $50 at 5%. Before you set your rate sheet, confirm with the Treasurer what counts as the taxable base, such as cleaning fees or service fees.

Your checklist, in order

  1. Form the entity and file with the Department of State. For an LLC, budget $125 plus any expedited fee, and calendar the annual report window of January 1 through September 30 for the $7 fee.
  2. Get the parcel's zoning confirmed in writing by the township.
  3. Ask the township whether it levies a business privilege or mercantile tax. Do not assume the answer from the county or from a neighboring municipality.
  4. Confirm the building permit office, fees and timeline.
  5. If you handle food, confirm the PDA license.
  6. Register state tax accounts in myPATH. Sales tax is 6% on taxable sales.
  7. If you have employees, register and remit EIT and LST through the Cumberland County Tax Bureau.
  8. If you rent rooms or beds, register with the County Treasurer for the 5% hotel tax.
  9. If you operate under a name other than your legal name, file the $70 fictitious name registration with the Department of State.

Common mistakes

  • Searching for a county business license and stopping there, when the real requirements are state filings and township rules.
  • Listing a post office box as your registered office.
  • Assuming your township has no business tax because one neighboring collector lists only per capita and real estate taxes.
  • Signing a lease before getting written zoning confirmation.
  • Assuming Airbnb or VRBO handles your monthly hotel tax report.
